Resort Outfitters — Twilio Messaging Campaign

1. Agreement to Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“Participant,” “you,” or “your”) and Resort Outfitters (“Company,” “we,” “us,” or “our”) governing your participation in our SMS/MMS messaging campaign operated through Twilio’s communications platform.

By opting into our messaging campaign — whether via a web form, keyword reply, short code, or any other opt-in mechanism — you agree to be bound by these Terms. If you do not agree, do not opt in or continue to participate in the campaign.

 

2. Program Description

Resort Outfitters operates a recurring SMS/MMS messaging campaign to provide participants with:

  • Promotional offers, discounts, and exclusive deals on outdoor and resort gear
  • New product announcements and seasonal collection updates
  • Order confirmations, shipping notifications, and service updates
  • Event invitations, contests, and loyalty program communications
  • Customer service and support follow-ups

Message frequency will vary based on campaign activity. You may receive up to [X] messages per month. Message and data rates may apply.

 

3. Eligibility

To participate in this campaign, you must:

  • Be a resident of the United States (or applicable country where the campaign is offered)
  • Be at least 18 years of age, or the age of majority in your jurisdiction
  • Own or have authorized use of the mobile phone number provided at opt-in
  • Have a mobile device capable of receiving SMS/MMS messages

Resort Outfitters reserves the right to verify eligibility at any time and to disqualify any participant who does not meet these requirements.

 

4. Opt-In and Consent

4.1 How to Opt In

You may opt into the campaign by:

  • Texting a designated keyword (e.g., JOIN, RESORT, or DEALS) to our short code or long code number
  • Submitting your mobile number via our website opt-in form at resortoutfitters.com
  • Providing your mobile number at point of sale or during checkout with express consent
  • Any other consent mechanism expressly provided by Resort Outfitters

4.2 Confirmation

Upon successful opt-in, you will receive a confirmation message that includes program details, message frequency, and instructions for opting out. Your continued participation constitutes ongoing consent to receive messages.

4.3 Consent Requirements

By opting in, you expressly consent to receive autodialed or prerecorded marketing messages from Resort Outfitters at the mobile number provided. Consent to receive marketing messages is not a condition of purchase.

 

5. Opt-Out / Unsubscribe

You may opt out of the campaign at any time using any of the following methods:

  • Reply STOP, QUIT, CANCEL, END, or UNSUBSCRIBE to any campaign message
  • Contact us at privacy@resortoutfitters.com with your opt-out request
  • Call or write to us using the contact details in Section 14

Upon receipt of a valid opt-out request, we will send a one-time confirmation message and cease all further campaign messages to your number. Opting out of marketing messages does not affect transactional messages related to existing orders or accounts.

To re-enroll after opting out, you must provide fresh express consent through one of the opt-in methods described in Section 4.

7. Charges, Carriers, and Compatibility

Resort Outfitters does not charge for participation in this messaging campaign. However, standard message and data rates imposed by your mobile carrier may apply to messages sent and received. These charges are your sole responsibility.

This campaign is compatible with most major U.S. wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, Sprint, Boost Mobile, and U.S. Cellular. Carrier support may vary. Resort Outfitters and Twilio are not liable for delayed or undelivered messages due to carrier limitations or network issues.

This program may not be available on all devices or in all geographic areas.

 

8. Participant Conduct and Content Standards

When interacting with our campaign (e.g., replying to messages, participating in surveys or contests), you agree not to:

  • Submit false, misleading, or fraudulent information
  • Use abusive, harassing, defamatory, or offensive language
  • Impersonate any person or entity
  • Attempt to access, interfere with, or disrupt campaign systems or infrastructure
  • Use automated tools, bots, or scripts to interact with the campaign
  • Violate any applicable law or regulation

Resort Outfitters reserves the right to remove any participant from the campaign for violating these standards without notice or liability.

 

9. Intellectual Property

All content delivered through this campaign — including text, images, trademarks, logos, product names, and promotional materials — is the property of Resort Outfitters or its licensors and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to view campaign content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or create derivative works from campaign content without prior written consent from Resort Outfitters.

 

10. Disclaimers and Limitation of Liability

10.1 Service Availability

Campaign messages are provided on an “as is” and “as available” basis. Resort Outfitters does not warrant that messages will be delivered timely, error-free, or uninterrupted. We reserve the right to modify, suspend, or discontinue the campaign at any time without notice.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Resort Outfitters, its affiliates, officers, employees, agents, and service providers (including Twilio) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your participation in this campaign, including but not limited to:

  • Failure to receive or delayed receipt of messages
  • Unauthorized access to your personal information
  • Reliance on campaign content for any purchasing or financial decision
  • Technical errors, interruptions, or omissions in campaign communications

10.3 No Warranties

Resort Outfitters makes no representations or warranties regarding the accuracy, completeness, or fitness for a particular purpose of any campaign content or offers.

 

11. Indemnification

You agree to indemnify, defend, and hold harmless Resort Outfitters, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your participation in the campaign
  • Your violation of these Terms
  • Your violation of any applicable law or third-party rights
  • Any content or information you submit through campaign interactions

 

12. Modifications to Terms

Resort Outfitters reserves the right to update or modify these Terms at any time. Material changes will be communicated via campaign message or posted at resortoutfitters.com prior to taking effect. Your continued participation in the campaign after the effective date of any modification constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically. The “Last Updated” date at the top of this document reflects the most recent revision.

 

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of [Your State], without regard to its conflict of law provisions.

15. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Section headings are for convenience only and do not affect the interpretation of these Terms.
